자료실유럽 보행자 권리헌장 (1988년 유럽의회 제정)

국내에서 1993년, 녹색교통운동에서 보행권이라는 용어가 처음으로 나오기 이전인 1988년, 유럽에서는 보행자 권리 헌장이 제정되었으며

보행자에 대한 권리를 체계적으로 정리하였습니다.

가장 중요한 보행자의 권리는 "건강한 환경에서 삶을 영위하고 인간의 육체적, 정신적인 행복을 충분히 보호받을수 있는 환경으로 갖추어진 공공영역이 ㅈ주는 쾌적성을 누리 권리가 있다" 입니다.

우리나라에서는 2012년에 들어서야 보행안전법(보행안전 및 편의증진에 관한 법률)이 제정되었으며 보행안전법에서는 "보행자가 안전하고 편리하게 걸을 수 있는 쾌적한 보행환경을 조성하여 각종 위험으로부터 국민의 생명과 신체를 보호하고, 국민의 삶의 질을 향상시킴으로써 공공의 복리 증진에 이바지함을 목적으로 한다" 라고 명시되어 있습니다.


유럽 보행자권리헌장 (1988년 유럽의회 제정)

Ⅰ. 보행자는 건강한 환경에서 삶을 영위하고 인간의 육체적, 정신적인 행복을 충분히 보호받을 수 있는 환경으로 갖추어진 공공영역이 주는 쾌적성을 누릴 권리가 있다.

Ⅱ. 보행자는 자동차의 이용이 적당한 도시나 주거 중심지에서 거주할 권리가 있으며, 보행이나 자전거 이용거리 내에서 쾌적성을 누릴 권리가 있다.

Ⅲ. 어린이, 노인, 장애자들도 쉽게 사회와 접촉을 할 수 있으며, 그들의 연약함을 약화시키지 않는 도시를 기대할 권리가 있다.

Ⅳ. 장애자들은 공공지역, 교통체계, 대중교통의 조정을 포함하여 개인의 이동성을 극대화 해줄 수단을 선택할 권리가 있다.

Ⅴ. 보행자에게는 보행자 전용으로 사용되며, 최대한 넓고 보행구역뿐만이 아니라 전체 도시와 조화를 이루며, 서로 안전하게 연결되어 있는 도로를 가질 권리가 있다.

Ⅵ. 보행자는 다음과 같은 특별한 권리를 기대할 수 있다.

   a. 차량의 배기가스, 소름발생기준 혀용 기준 준수 ;

   b. 대기오염, 소음을 발생시키지 않는 모든 공공교통체계의 도입 ;

   c. 도시지역에서의 식수(植樹)를 포함함 “green lung(도심공원)”의 창조 ;

   d. 보행자와 자전거통행자를 효율적으로 보호하기 위한 속도제한과 도로, 교차로 설계의 기준 준수 ;

   e. 위험한 자동차 운행을 조장하는 부적당한 광고의 금지 ;

   f. 장애자를 고려한 효율적인 교통신호 설치 ;

   g. 차량과 보행자간의 연계가 쉽고, 이동의 자유와 정지의 가능성을 보장해 줄 교통수단의 선택과 개발 ;

   h. 신호체계를 좀더 효율적으로 만들고, 차량을 좀더 유용하게 만들기 위한 차량의 외형이나 장비의 조정 ;

   i. 사고를 낸 사람이 사고에 대한 재정적 책임을 질 수 있게 하는 재정부담체계의 도입 ;

   j. 운전자 교육프로그램의 실시와 도로의 이용자를 보호하는 도로상의 적절한 시설이 설치되어야 할 것이다.

Ⅶ. 보행자는 전혀 방해를 받지 않고 이동할 권리가 있으며, 이러한 것은 교통수단의 통합적 이용을 통해 이룰 수 있다. 특히 보행자가 가지는 권리에는 다음과 같은 것들이 있다.

   a. 생태학적으로 안전하고 폭넓게 잘 정비된 공공 교통서비스는 정상인부터 장애자까지 모든 시민의 수요를 충족시킴 ;

   b. 도시전지역에 자전거 시설을 설치 ;

   c. 주차지역은 보행자의 이동이나 보행자가 특색있는 건축물을 보며 즐기는 것을 방해하지 않도록 위치해야 한다.

Ⅷ. 각 회원국은 보행자 권리와 생태학적으로 건전한 교통형태에 대한 종합적인 정보를 가장 적절한 형태로 제공하여, 어린이들도 활용할 수 있도록 하여야 한다.

The European Charter

of pedestrians' rights


Adopted by the

Eupopean Parliment in 1988


Ⅰ. The pedestrian has the right to live in a healthy environment and freely to enjoy the amenities offered by public areas under conditions that adequately safeguard his physical and psychological well being.

Ⅱ. The pedestrian has the right to live in urban or village centres tailored to the needs of the motor car and to have amenities within walking or cycling distance.

Ⅲ. Children, the elderly and the disabled have the right to expect towns to be places of easy social contact and not places that aggravate their inherent weakness.

Ⅳ. The disabled have the right to specify measures to maximise their independent mobility, including adjustments in public areas, transport systems and public transport (guidelines, warning signs, acoustic signals, accessible buses, trams and trains).

Ⅴ. The pedestrian has use, are as extensive as possible and are not mere 'pedestrian precincts' but in harmony with the overall organization of the town, and also the exclusive right to connecting short, logical and safe routes.

Ⅵ. The pedestrian has a particular right to expect ;

(a) compliance with chemical and noise emission standards for motor vehicles which scientists consider to be tolerable;

(b) the introduction into all public transport systems of vehicles that are not a source of either air or noise pollution ;

(c) the creation of 'green lungs' , including the planting of trees in urban areas;

(d) the fixing of speed limits and modification to the layout of roads and junctions as a way of effectives safeguarding pedestrians and bicycle traffic ;

(e) the fixing of advertising which encourages an improper and dangerous use of the motor car ;

(f) an effective system of road signs whose design also takes into account the needs of children ;

(g) the adoption of specific measures to ensure that vehicular pedestrian traffic has ease of access to, and freedom of movement and the possibility of stopping on, roads and pavement respectively ; 

(h) adjustments to the shape and equipment of motor vehicles so as to give a smoother line to those parts which project most and to make signalling systems more efficient ;

(i) the introduction of the system of risk liability so that the person creating the risk bears the financial consequences there of ;

(j) a drivers' training programme designed to encourage suitable conduct on the roads in respect of pedestrians and other slow read users.

Ⅶ. The pedestrian has the right to complete and unimpeded mobility, which can be achieved through the integrated use of the means of transport. In particular, he has the right to expect :

(a) an ecologically sound, extensive and well-equipped public transport service which will meet the needs of all citizens, from the physically fit to the disabled;

(b) the provision of facilities for bicycles throughout the urban areas;

(c) parking lots which are sited in such a way that they affect neither the mobility of pedestrians nor their ability to enjoy areas of architectural distinction.

Ⅷ. Each member State must ensure that comprehensive information of the rights of pedestrians and on alternative ecologically sound forms of transport is disseminated through the most appropriate channels and is made available to children from the beginning of their school career.
